Currently, BEPL have its ‘Porsche Design Stores’ located at ‘Hyderabad Airport’ and ‘Delhi Airport’, INDIA. This e-Platform is an initiative by the BEPL to provide the luxury segment products to its clients across the nation. This electronic record is generated by a computer system and does not require any physical or digital signatures.

For the purpose of this ‘Terms of Use’, wherever the context so requires ‘You’ or ‘User’ or ‘Client’ or ‘Customer(s)’ shall mean any natural or legal person who has agreed to become a buyer / purchase a product on this e-Platform by providing its personal data while registering on the e-Platform as Registered User. The term ‘Porsche Design Online Shop’, ‘BEPL’, ‘We’, ‘Us’, ‘Our’ ‘Company’ shall mean “e-Platform” or “PD Online Shop”.

When You use any of the services provided by Us through the e-Platform, including but not limited to, (e.g. Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the rights, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of this e-Platform following the posting of changes will means that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the e-Platform. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by BEPL Policies including but not limited to Privacy Policy as amended from time to time.

Visitors to this e-Platform are bound by the following terms and conditions ("terms") so please read these carefully before continuing to use this site. 1. YOUR ACCOUNT, PASSWORD, AND SECURITY: INSTEAD (USER ACCOUNT )

If You use this e-Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete, We shall have the right to indefinitely suspend or terminate or block access of your membership on the e-Platform.

You agree to (i) immediately notify us of any unauthorized use / breach of your password or account and (ii) ensure that you properly logout or exit from your account at the end of each session.

2. E-PLATFORM ELIGIBILITY:

Any transaction(s) on this e-Platform is available only to person who are eligible to enter into the contract as per the Indian Contract Act, 1872. Person(s) who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents, unsound etc. are not eligible to use this e-Platform. If you are a minor i.e. under the age of 18 years, you may use this e-Platform or access content on this e-Platform only under the supervision and prior consent/ permission of your parent or legal guardian. e-Platform shall reserves the rights to terminate your membership and / or refuse to provide you with access to this e-Platform if it is has been brought to our notice or if it is discovered that You are under the age of 18 years and transacting on this e-Platform. Please note that there could be risks in dealing with underage persons or people acting under false pretence.

3. DELIVERY ZONE AND PACKING:

a. This e-Platform shall only supply to the client whose delivery and an invoice address is/are within the territory of India and subject to availability of our delivery services. The client is liable for the payment which includes taxes and other charges (if any) against the product purchased via this e-Platform. No deliveries shall be made outside India. However, the shipment cost in respect of replacement or returning the product(s) to e-Platform shall be borne and incurred by client. Further, any delays and/or damages resulting from the client’s failure to fulfil of these obligations are the responsibility of the client.

b. Unless otherwise provided by e-Platform, the shipment / freight costs for delivery of product from e-platform to customer’s destination / address of delivery shall be responsibility of e-Platform, subject to limit of one hundred kilometres within the radius of e-Platform product dispatch centre i.e. Hyderabad, India.

c. The customer agrees hereby that if the shipment / freight rates change before shipment of its ordered product, the price shall be included / adjusted in an invoice accordingly.

d. The delivery / freight cost is/are differing from place to place across the nation, it is imperative that you choose the correct delivery location when placing an order; failure to do so will be presume that the order is cancelled.

e. This e-Platform is responsible for insuring to cover the risk of loss or damage during carriage / transits from e-Platform to customer’s desired destination or address of delivery. Further, the product shall be treated as accepted without any dispute, if no return / replacement request made to e-Platform by the customer as per the condition of this term of use.

f. The cost of packaging of product shall be the responsibility of e-Platform. No charges that arise in connection with the transportation (for cartons, wrapping, packing, boxing, delivery to shipment centre etc.) shall be paid by the Customer.

4. LICENSE:

By registering on this e-Platform, You confirm that use of this e-platform shall be for his/her personal purpose and not for any commercial purpose. You confirm that Your rights to access, use, deal with or transact at this e-Platform cannot be assigned to any other person and custody of User Id and Password to access, deal with or transact at this e-Platform shall be sole responsibility of You and You shall be responsible and liable for any misuse of Your User Id and Password assigned to You.

5. SCOPE:

As per the terms of use, e-Platform and Client hereby agrees to sale and buy Porsche Design Product (i.e. hereby referred as Product) through this e-Platform only. This e-Platform may at its sole discretion, provide its products at the prevailing rates and terms. All defective product(s) purchased by Client through this e-Platform shall be replaced solely by this e-Platform only, as per the replacement / return policy as case may be against said defective product which is subject to verification and satisfaction by this e-Platform officials. This e-Platform may express clear acceptance in text form i.e. by sending acceptance of the contract by e-mail or implicitly through the fact that this e-Platform has sent the goods for dispatch or begun performance of the service.

A mere acknowledgement of receipt of the Clint’s order by us shall not constitute acceptance of that order. Once the contract has been made, this e-Platform will not store the contract in a form that is accessible to the Client. You agreed to receive invoices in electronic form via e-mail. A paper invoice will be enclosed with your order. In the case of partial deliveries, the invoice will accompany the partial delivery with the highest gross invoice amount.

 

For discounts and/or discounted or free products (gifts) that are granted if minimum order values have been reached, the following shall apply in case of returns/withdrawal of the purchase order: (i) the granted discounts shall be void if a return reduces the minimum order value; (ii) if a return causes the price to fall below the minimum order value, discounted or free products (gifts) must either be returned as well or the customer can keep the gift by purchasing it for the regular sales price when concluding the purchase contract.

6. USAGE OF E-PLATFORM

You agree, undertake and confirm that your use of e-Platform shall be strictly governed by the following binding terms and conditions:

a) All commercial/contractual terms are offered by and agreed to between You and e-Platform only. The commercial/contractual terms include without limitation to price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services. This e-Platform does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the You and other than this e-Platform.

b) This e-Platform makes Representation or Warranty as to specifics (such as quality, value, saleability) of the products or services proposed to be sold or offered to be sold or purchased by you on this e-Platform only.

c) This e-Platform does not implicitly or explicitly support or endorse the sale or purchase of any products or services other than this e-Platform. This e-Platform accepts no liability for any errors or omissions, whether on behalf of other than this e-Platform or third parties or any outside stores

d) This e-Platform is not responsible for any non-performance or breach of any contract entered into between you and other than this e-Platform. We does not guarantee for the product / services that the concerned you/buyer and/or seller which has been perform any transaction other than this e-Platform. We shall not require mediating or resolving any dispute or disagreement between you/buyers and sellers other than this e-Platform. At no time shall we hold any right, title or interest over the products nor shall we have any obligations or liabilities in respect of such contract entered into between you/buyers and sellers other than this e-Platform.

e) This e-Platform is only an e-platform that can be utilized by Users to reach a larger base to buy the Porsche Design products. This e-Platform is only providing an e-platform for communication and it is agreed that the contract for sale of its products shall be a strictly bipartite contract between you and this e-Platform.

f) This e-Platform is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of the product(s) which are out of stock, unavailable or back ordered made/ordered under this e-Platform.

g) Pricing on any product(s) as is incorrectly reflected on this e-Platform may due to some technical issue, typographical error or product information published, in such an event this e-Platform reserve the rights that may cancel such your order(s) made herein.

h) You release and indemnify this e-Platform and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of this e-Platform and specifically waive any claims that you may have in this behalf under any applicable law of India. Notwithstanding its reasonable efforts in that behalf, this e-Platform shall not take responsibility or control the information provided by other than this e-Platform.

i) This e-Platform currently does not facilitate business to business transaction. You are advised to refrain from transacting on this e-Platform if you intend to avail the benefits of input tax credit or any other tax benefit under laws of India.

7. PAYMENTS & TERMS

Membership on the e-Platform is free for buyers. This e-Platform does not charge any fee for accessing and browsing this e-Platform. This e-Platform reserves the rights to change its charges and /or fee on its product from time to time without any prior intimation to buyer/you. In particular, this e-Platform may at its sole discretion introduce new product and/or modify some or its entire existing product offered on this e-Platform portal. In such an event e-Platform reserves the rights to introduce new charges/price or other similar charges /fee for its new product(s) offered or amend / introduce new charges/price for existing product(s), as the case may be. Changes to the Price shall be posted on this e-Platform and such changes shall automatically become effective immediately after they are posted on this e-Platform. Unless otherwise stated, all price / fees shall be quoted in Indian Rupees only including taxes and duties as per the applicable laws of India. You shall be solely responsible for compliance of all applicable laws of India for making payments towards buying the Porsche Design product(s) through this e-Platform only.

a) All payment shall be in an Indian Rupee (INR) (₹) only.

b) Customer shall forthwith make payments towards cash receipt or invoice generated by this e-Platform.

c) Customer shall make payment of all charges against purchase of the Product through this e-platform.

d) Charges payable by the Customer are exclusive of applicable taxes unless expressly stated to the contrary.

e) Customer shall require for processing the payment online using the support provided by this e-Platform. Once the payment is credited on our account before despatch of your purchase product, this e-Platform shall take all reasonable care, in so far as it is our power to do so, to keep the details of your order and payment secure. However, in the absence of negligence on your part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from this e-Platform.

f) No delivery of product until payment has been received or shall make delivery concurrently against payment. The delivery time is normally minimum 7 working days (for shipping within India) from the receipt of payment, up to, but not exceeding 30 working days after the duly release of the payment.

g) Subject to this term of use, the said purchased product(s) may be replace for any reasons such as different size / capacity / model, the customer shall be responsible to make payment of differential amounts to this e-Platform for increase in the charges due to change in the Products. However, e-Platform shall not be responsible for refunding any monies as a result of reduction in product charges/price, to the Customer if the replacement took place for whatever may be the reason

h) Prices and all elements are included in the price such as taxes and other similar charges (if any), In this e-Platform, the prices shall be displayed against each product before the order is placed by the Customer with a facility to pay the possible payment methods (Net banking; UPI transfer; Debit / Credit Card Payment; Cash on Delivery (COD).

i) If a credit card payment, credit transfer or direct debit is unpaid, revoked or returned, the bank charges thereby incurred by this e-Platform shall be borne by the customer.

j) Any discounts and/or discounted or free products (gifts) or festival offer or promotional of product(s) are subject to sole discretion of the company.

8. CANCELLATION OF ORDERS

Any order placed using this e-Platform excluding at the demanding time of the year, e.g. Independence Day, Republic Day, Diwali, Dushara, Eid, Christmas, Onam or any other festival of India etc. may normally shipped to customer with two working day of order receipt by us. If customer wishes to cancel BEFORE we have dispatched the products so placed, customer must do so by sending us an email. If Customer’s order has not been dispatch, it will be cancelled and there will be no charge whatsoever.

If Customer change its mind and cancel AFTER its order has been dispatch to customer or after receiving the product customer shall be subject to our returns policy. All product returned must be unused and in the same condition as they were originally dispatched from e-Platform. We will not accept for exchange or refund any item which has been used, or is not in the exact condition in which it was dispatched by us, (unless the item is faulty).

Customer must contact us by sending email to confirm which items are being returned including details of Ean code / Article No. Customer shall return the product by in hand delivery or express / premium class delivery along with the Proof of Posting at its (customer’s) own cost and expenses. There will be no refund on the said cost of returning the product. Any free gifts associated with product must be returned at the same time. We request to return the product to the address provided, along with a note of customer details and the detail reason for returning the product. The e-Platform shall reserve the rights either to issue credit note or refund the amount or any payable amount after due adjustment of invoice to the customer as per the discretion of the e-Platform. In case of refund, e-Platform shall made to the original charged account within 30 days of receipt of the returned goods. These conditions do not affect your statutory rights.

9. CONDUCT AND RULES OF THIS E-PLATFORM:

You agree, undertake and confirm that your use of this e-Platform shall be strictly governed by the following binding principles:

1. You shall not host, display, upload, modify, publish, transmit, update or share any information which:

a. belongs to another person and to which You does not have any right to;

b. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;

c. is misleading in any way;

d. is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;

e. harasses or advocates harassment of another person;

f. involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";

g. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

h. infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity;

i. promotes an illegal or unauthorized copy of another person's copyrighted work such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

j. contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);

k. provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;

l. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

m. contains video, photographs, or images of another person (with a minor or an adult).

n. tries to gain unauthorized access or exceeds the scope of authorized access to the e-Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the e-Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

o. engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of virtual products related to the e-Platform. Throughout this Terms of Use, prior written consent of the e-Platform means a communication coming from our Legal Department, specifically in response to Your request, and specifically addressing the activity or conduct for which You seek authorization;

p. solicits gambling or engages in any gambling activity which we, in our sole discretion, believes is or could be construed as being illegal;

q. interferes with another USER's use and enjoyment of the e-Platform or any other individual's User and enjoyment of similar services;

r. refers to any electronic platform or URL that, in our sole discretion, contains material that is inappropriate for this e-Platform or any other Platform, contains content that would be prohibited or violates the letter or spirit of these Terms of Use.

s. harm minors in any way;

t. infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;

u. violates any law for the time being in force;

v. deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

w. impersonate another person;

x. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancel bots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;

y. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

z. shall not be false, inaccurate or misleading;

aa. shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.

bb. shall not create liability for us or cause us to lose (in whole or in part) the services of our internet service provider ("ISPs") for this e-Platform.

10. OTHER TERMS AND CONDITIONS

a) Any return / replacement of product shall be subject to e-Platform return / replacement policy. If e-Platform disagrees for any return / replacement request then customer can raise a dispute by writing to concern official email id pdcorphyd@bbmbommidala.com only.

b) Any replacement / return request shall be made by the customer within 48 hours from the date of receipt/delivery of the product purchase through this e-Platform, failing which shall be treated as acceptance of product without any dispute.

c) In case the customer made the payment whatever may be the mode towards the product purchased through this e-Platform and if the said product(s) is/are not available or out of stock or whatever may be the reason, subsequently, e-Platform shall refund the amount to the customer without any additional charges / interest by making payment to customer’s designated bank account through online only and customer shall be obligate to accept the refund amount.

d) The Porsche design online shop shall sent intimation to customer seeking either "approval" or "rejection" of the replacement request.

e) Subject to terms of this agreement in case we accept the replacement / return of product, the customer shall be required to return the product to e-platform only. On receipt of the replacement / return product, e-Platform may replace the product or refund the amount or issue credit note for product amount or any payable amount after due adjustment of invoice to the Customer as per the discretion of the e-Platform.

f) The customer hereby agree that if e-Platform doesn't received the replacement / return product then e-Platform is not obliged to proceed for replacement of product or refund the amount to customer.

g) Any purchase of product by the customer under the promotional or discounts or any offers by the e-Platform is not eligible for replacement / return. The customer is/are not entitled for the any replacement or refund or credit note against product purchase under such promotional or discounts or any offers subject to verification, inspection of product and satisfaction of the e-platform.

h) This e-Platform shall reserve the rights on the conduct its own procedure reasonably for the physical verification, inspection and condition of the product so return / replace purpose. Any decision of e-Platform in respect of replacement or return of the product shall be binding on the customers.

i) The Company reserves the right, at its discretion, to change, modify, add, or remove part of these Terms of use at any time by amending the Terms. Please check these Terms periodically for changes. Your continued use of the site or product or services after the changes constitutes your binding acceptance of such changes.

j) The e-Platform reserves the right to change or discontinue any content, products and/or services made available through the site at any time and without any notice to you.

k) The e-Platform, its affiliates, its supplier, franchisor shall be sole owner of the content included on the site, the compilation of all content on the site, including text, documents, forms, software, images, sounds, names, logos, trademarks, product marks, service marks and all other materials used on this portal / e-platform and are protected by applicable intellectual property right at both national and international level.

l) The Product(s) images / display are for illustrative purposes only and may differ from the actual product(s). Due to differences in monitors, colours, resolutions of products may also appear different to those shown on this e-Platform portal. Some products may have an associated or related image / display / photo. These are for reference only and should be considered illustrative. The product images / display on e-Platform are subject to copyright, but may be used on the condition that the user credits the source of the picture @ https://porschedesignindia.com

11. WARRANTY.

a. The product and/or services, information and functions contained on our site are provided "as is" without warranty of any kind. We expressly disclaim any and all representations and warranties, express or implied, including those of accuracy, completeness, timeliness, non-infringement, merchantability and fitness for a particular use or purpose of the information, functions or product or services included on our site, or that the site's operations will be uninterrupted or error-free. We are not responsible for the content of any linked website or any link contained in a linked website, except to the extent that such website or link is owned and operated by this e-Platform.

b. Subject to this term of use the warranty of the each product manufactured, sold or delivered by this e-Platform has been in conformity with all applicable contractual commitments and all express and implied warranties, and neither the e-Platform nor any of its affiliates has any material liability (and there is no basis for any present or future action, suit, proceeding, hearing, investigation, charge, complaint, claim, or demand against any of them giving rise to any liability) for replacement or repair thereof or other damages in connection therewith.

c. Repaired product(s) are not covered by warranty.

12. RELATIONSHIP.

This term of use does not establish any full or part relationship of partnership, joint venture, employment, associates, franchise or agency between you and us.

13. ASSIGNABILITY

This e-Platform may assign our rights and delegate our duties under these terms of use either in whole or in part at any time, at our sole discretion, and without your consent. You may not assign, sublicense or otherwise transfer your rights or obligations, in whole or in part, under these terms of use to anyone else.

14. NO WAIVER AND SEVERABILITY:

The waiver of any breach of any clauses of this term of use shall not be deemed to be a waiver of any repetition of such breach or in any manner affect any other terms or conditions of this term. In the event that any clause of this term of use is held to be unenforceable under the court of law, it will not affect the validity or enforceability of the remaining provisions or the clauses and will be replaced by the legal enforceable provision or clauses that are the closest to the intention underlying the unenforceable provision or clauses.

15. REPLACEMENT AND RETURNS POLICY

a) The replacement under this term of use means an action or process of replacing the product purchase by the customer through this e-Platform in place of another product on this e-Platform only.

b) The Return under these terms of use means an action of giving back the item purchased through this e-Platform only, by the customer.

Following situations may arise:

• 1. Purchase product was defective;
• 2. Purchase product was damaged during the Shipping;
• 3. Purchase Products was / were missing;
• 4. Wrong product was sent by this e-Platform;

c) The e-Platform shall accept the return / replacement of product which is subject to internal investigation and satisfaction of the reasons provided by its customer.

d) We encourage the customers to review the listing before making the purchase decision. In case customer orders a wrong product, customer shall not be entitled to any return/refund.

e) Any defect found by the customer then the said customer shall either at the time of delivery or within 7 days from the date of delivery of the product(s), approach us for replacement / return of said product/s as case may be.

f) E-Platform while closing the return or replacement of product request can select one of the following:

• - It shall hold the replacement till its team collect the shipment from the customer.
• - It shall hold the return / replacement till its team collect the shipment from the customer before the refund against the product that was purchase.

g) In the event if we accept the return request raised by the Customer, then Customer will have to return the product purchased from this e-Platform and then the refund shall be credited to the Customers designated bank account only.

16. DISPUTES (RESOLUTIONS) POLICY:

a) Generally, transactions are conducted smoothly on this e-Platform for purchase of our Product(s). However there may be some cases where both the customer and e-Platform may face issues. For the purpose we have a Dispute Resolution process in order to resolve disputes.

b) The 'Dispute' can be defined as a disagreement between a customer and e-Platform in connection with a transaction made on this e-Platform and/or either party not being completely satisfied with the resolution of their complaint/issue.

c) The Customer or e-Platform may raise a dispute, but at the first they should attempt to resolve the issue amicably. Please note that whenever a Customer raises a dispute, then e-Platform shall reserve the right to put on hold the payment (refund / replacement of product) for that order unless and until the issue is resolved.

d) Whenever there is a disagreement, the Customer can write to e-Platform dispute resolution official email id : dispute@....com , while the e-Platform can write to customer’s registered email id or mobile number, in order to raise a dispute. Disputes can be raised at a particular transaction level only related to purchase of our product available on this e-Platform.

17. TERMINATION:

Notwithstanding anything contained herein above, e-Platform shall be entitled to terminate or restrict the product immediately without any notice in any of the following events:

a) If the Customer is in breach of this term of use and the Customer does not made the remedy for the breach within 3 (three) days of the notification by e-Platform.

b) If the Customer transfers the Product to any other person.

c) If the Customer relocates the Product to a location which is outside the municipal limits of the city /town where the service Centre of e-Platform is located.

d) If the Customer is declared insolvent or bankrupt or is liquidated or if it being a firm / company, is dissolved / windup.

e) If a trustee or receiver is appointed to take over the assets of the Customer.

f) If the e-Platform refunds the price of the Product to the Customer.

g) If e-Platform at its sole discretion determines that the declaration provided by the Customer is incorrect.

h) The conditions or consequences of Force Majeure continue for such length of time that further performance of the Services would be commercially frustrated and beyond the control of e-Platform.

i) In the event of termination for any reason whatsoever, the e-Platform shall be entitled to recover all outstanding payments due and payable by the Customer. E-Platform shall, under no circumstances be responsible for refunding any amounts to the Customer including without limitation due to termination of this terms of use by the Customer or due to termination by e-Platform.

j) The customers are entitled to withdraw from this agreement within 7 days without giving any reason.

18. CONSEQUENCES OF TERMINATION:

a) If you withdraw from this contract, we may refund all payments received from you, including the delivery costs (except for any additional costs that may have arisen if you chose a delivery method other than the most economical standard delivery method offered by us), without undue delay and at the latest within 14 days from the date on which we received notification regarding your withdrawal from the contract. For this refund we will use the same method of payment as used by you in the original transaction, unless expressly agreed otherwise with you. In no case will we charge any fees for refunding the payment. We may refuse to refund the payment until we have received the returned goods or until you have submitted proof of returning the goods, whichever event occurs first.

b) You must return or deliver the goods to address mentioned under these terms of use.

c) You shall without undue delay and in any case at the latest within 14 days of the date on which you notify us that you are withdrawing from this contract. The return period shall be deemed complied with if you send the goods before the 14 day period expires.

d) You are responsible for the direct costs of returning the goods to us.

19. LIMITATION OF LIABILITY

In no event e-Platform or its associate or management shall be liable to its customer or other party or any other person or entity for any special, exemplary, indirect, incidental, consequential or punitive damages of any kind or nature whatsoever (including, without limitation, lost revenues, profits, savings or business, or contribution or indemnity in respect of any claim against the party) or loss of records or data, whether in an action based on contract, warranty, strict liability, tort (including, without limitation, negligence) or in any way connected with the use of this e-platform, Products and/ or the services and/ or the Agreement or with the delay or inability to use this e-platform Webpage, or for any information, materials and/or Products uploaded, posted, emailed, transmitted and/ or obtained through this e-platform Webpage, or otherwise arising out of the use of this e-Platform Webpage, even if such party has been informed in advance of the possibility of such damages or such damages could have been reasonably foreseen by such party and the e-Platform’s aggregate liability, if any, for any or all losses or injuries to other arising out of or under this e-Platform transaction / portal shall not exceed the aggregate amount paid by the Customer for the Purchase of Product through this e-Platform. If you are dissatisfied with any content of the e-Platform Webpage available herein or with any of these Terms & Conditions, You are sole and exclusive remedy is to discontinue using the e-Platform Webpage.

20. APPLICABLE LAW AND JURISDICTION:

This e-Platform terms and conditions are governed by and to be interpreted in accordance with laws of India, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree, in the event of any dispute arising in relation to these terms and conditions or any dispute arising in relation to the e-platform portal whether in contract or tort or otherwise, to submit to the jurisdiction of the courts located at Hyderabad, India only for the resolution of all such disputes.

21. VERIFICATION:

The User hereby affirms that the information provided by him / her is true, correct and complete to the best of his / her knowledge and belief. The User agrees and understands that he / she will be solely responsible in the event of any inaccuracy or deviation therefrom at a later stage.
